Stallion Tender Conditions
How to complete your tender
Complete the tender form nominating the stallion and tender price before lodging it with the CQTBA by 5pm on Thursday 31 July 2008. (note all tenders must be inclusive of GST).

Tender Conditions
1. Acceptance of any tender shall be at the sole discretion of the CQTBA, and the highest or any tender shall not necessarily be the tender accepted by the CQTBA.
2. In general, the minimum tender shall be $880 (including GST) or a third of the service fee set out on the front pages of these conditions. The following specific minimum tenders apply Another Warrior ($2200), Fiery Match ($2000), Formlahaut ($3300), Hemingway ($2000), Pembroke ($3300) and Your Tent or Mine ($4400).
3. When a tender is accepted by the CQTBA, payment shall be made by:
i) A security deposit of $250 or 30 per cent of the tender price, whichever is the higher, within seven days of acceptance of the tender; and
ii) The remainder of the tender price, prior to the mare departing from the stud on which the stallion is located, or within seven days of obtaining a successful 45 day pregnancy test, whichever is the earlier.
4. Should the successful tenderer fail to pay the security deposit within the required time, the CQTBA reserves the right to award the service to another tenderer.
5. The successful tenderer shall correctly identify the mare to be served, and the stud owner shall not be responsible for any problem arising from the delivery of the wrong mare. At the time of the mare's delivery, the successful tenderer shall ensure the mare is accompanied by the relevant Document of Description or Identification Card.
6. The mare, the name of which shall be advised to the CQTBA, shall be free of any contagious disease, and in good health and condition, and eligible for entry in the Australian Thoroughbred Stud Book.
7. The successful tenderer shall comply with reasonable delivery conditions imposed by the stud.
8. While the stud will take all reasonable steps to care for the mare, neither the CQTBA, nor the stud accept any further responsibility for any accident, death, disease or injury to the mare during the time she is on the stud property.
9. The successful tenderer authorises the stud to engage a veterinary surgeon at the successful tenderer's expense to perform any service or treatment as the stud owner or his duly authorised representative, in the exercise of his absolute discretion, considers necessary and reasonable.
10. The successful tenderer shall pay the stud's reasonable agistment, foaling, transport and other costs within 30 days of receipt of the invoice. The successful tenderer shall also pay any veterinary surgeon's account for any service or treatment performed on his mare directly to the veterinary surgeon.
11. The successful tenderer shall pay any outstanding fees to the stud or veterinary surgeon, and the total amount of the tender price prior to the departure of the mare from the stud.
12. No live foal guarantees or free return entitlements are provided under this stallion tender. Some studs may grant these rights, but they need to be negotiated separately with the stud and do not form part of this contract.
13. Should the stallion die or become unfit for service, the stud will make its best endeavour to replace the stallion, but should that not be possible, then this contract shall cease to have any effect and any deposit paid by the successful tender shall be repaid by the CQTBA.
14. Should the mare die or become unfit to breed, the successful tenderer may replace the mare, but should that not be possible, then this contract shall cease to have any effect, except that the successful tenderer shall pay the stud's reasonable agistment, foaling, transport and other costs and any veterinary expenses.
15. This stallion tender will be completed on a confidential basis and neither the tenderer, nor the CQTBA, will discuss or disclose details of any tender with any other person or organisation. However, the CQTBA will be able to disclose the amount of the successful tender to each stallion owner together with the name and address of those lodging a tender for a service from their stallion.
